These Terms of Service ("Terms") constitute a legally binding agreement between you, the user ("you" or "User"), and Trainify AI ApS ("we," "us," or "our"), concerning your access to and use of the Trainify AI mobile application (the "App") and its related services (the "Service").
By creating an account, purchasing a subscription, or using the App, you agree that you have read, understood, and agree to be bound by all of these Terms.
If you do not agree with all of these Terms, then you are expressly prohibited from using the App and must discontinue use immediately. Your use of the App is also governed by our Privacy Policy, which is incorporated herein by reference.
Trainify AI is a subscription-based mobile application that provides users with a personalized AI coach. The Service includes, but is not limited to, the generation of personalized workout and diet plans, an interactive AI chat interface, progress tracking, and an educational content hub.
All workout and diet plans are generated by an artificial intelligence and are based solely on the data you provide.
Fair Usage Policy: To ensure a high quality of service for all users and to prevent abuse, the AI Coach chat feature is subject to a "Fair Usage Policy." We reserve the right to implement reasonable daily limits on the number of messages you can send to the AI Coach. These limits are in place to prevent excessive consumption of resources and ensure system stability.
You must be at least 18 years of age to use the App. By creating an account and using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.
You must register for a user account to access the Service. You agree to keep your password confidential and are responsible for all activity that occurs under your account.
You agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the App's onboarding process. This is critical, as your health data (age, weight, gender, allergies, etc.) is used to generate your plans. Providing inaccurate information may result in incorrect and potentially unsafe plans.
Access to the Service requires a paid subscription, which may be on a monthly or yearly basis.
All subscriptions are processed through the third-party platform from which you downloaded the App (e.g., the Apple App Store or Google Play Store). You must abide by their terms of service. We do not collect or store your payment card details.
We offer a 7-day free trial to new users. At the end of the free trial period, your chosen subscription plan will automatically begin, and your payment method will be charged unless you cancel at least 24 hours before the trial ends.
Your subscription will automatically renew for the same subscription period (monthly or yearly) unless you cancel it through your Apple App Store or Google Play Store settings at least 24 hours before the end of the current billing period.
Deleting the App will not cancel your subscription. You must manage and cancel your subscription directly through your App Store or Google Play account settings.
All refund requests are handled by the Apple App Store or Google Play Store, not by us, and are subject to their respective refund policies.
As a consumer in the EU or UK, you generally have a right to cancel a digital subscription purchase within 14 days. However, by creating an account and accessing the Service (e.g., accessing or using your personalized diet and/or workout plan, or interacting with the AI Coach), you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal. Please note that since we offer a 7-day free trial, you can cancel your subscription at any time during this trial period without being charged. Once the trial ends and the paid subscription begins, the service is considered fully delivered for that billing period. All requests for refunds are handled by the Apple App Store or Google Play Store in accordance with their policies.
This is the most important section of our agreement. Please read it carefully.
The Service provided by Trainify AI does not constitute medical advice, diagnosis, or treatment. The AI coach is an artificial intelligence, not a medical professional, registered dietitian, or certified personal trainer.
You should consult with your physician or other qualified healthcare provider before starting any new diet or fitness program, especially if you have pre-existing health conditions. Do not disregard professional medical advice or delay in seeking it because of information you have received through the App.
The exercise videos and descriptions provided in the App are for illustrative purposes only. You are solely responsible for ensuring that you perform exercises with correct form and technique to avoid injury. If you are unsure how to perform an exercise safely, we recommend consulting a certified personal trainer in person.
You acknowledge that any physical exercise involves a risk of injury, and any diet plan involves risks (such as unknown allergies or intolerances). You expressly agree that your use of the Service is at your sole risk.
To the fullest extent permitted by law, Trainify AI is not responsible or liable for any injuries, health problems, or damages you may sustain as a result of using the Service. This includes, but is not limited to, injuries from following workout plans, video instructions, or adverse reactions (e.g., allergic reactions) from following diet plans.
The workout and diet plans are generated by AI. While we strive for accuracy, the Service may contain errors, inaccuracies, or omissions. You should always use common sense and listen to your body when performing exercises or preparing meals.
You are responsible for the data, information, and content you provide to the App, including your check-in data, free-text notes, and any progress photos you choose to upload ("User Content").
You retain all ownership rights to your User Content.
By submitting User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to use, store, process, and display this content solely for the purpose of operating the App and providing the Service to you (e.g., to show you your progress photos or to allow the AI to analyze your check-in data).
You agree not to submit any User Content that is illegal, offensive, or violates the rights of others.
Security of User Content: While we use secure channels (encrypted HTTPS) for data transmitted within the App, standard email is not a secure method of communication. You acknowledge that if you choose to send sensitive User Content (such as health data or progress photos) to us via email, you do so at your own risk. Please use the App's built-in "Check-in" feature for uploading progress photos and health metrics, as this ensures they are stored securely.
All content in the App, including the software, design, text, graphics, logos, and the "AI Coach" personalities (collectively, the "App Content"), is the property of Trainify AI or our licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-transferable license to use the App for your personal, non-commercial use, subject to these Terms.
You may terminate this agreement at any time by using the "Delete Account" feature in the App's settings. This will permanently delete your account and all associated data, as described in our Privacy Policy.
We reserve the right to suspend or terminate your account and access to the Service, without notice, if you breach these Terms or for any other reason at our sole discretion.
The Service is provided on an "as-is" and "as-available" basis. We make no warranties that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Trainify AI and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the Service; (b) any errors, inaccuracies, or omissions in the AI-generated content; or (c) any unauthorized access to or use of our secure servers and/or any personal information stored therein.
These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the city courts of [Insert City, e.g., Copenhagen].
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means, to provide you with an opportunity to review the changes. Your continued use of the App after such notification constitutes your acceptance of the amended Terms.
